Who we are

This Privacy & Cookies Statement describes how the Firm and its affiliates collect, use, share and otherwise process Personal Data (as defined below), as it may process Personal Data on visitors to our website or any other individual whom the Firm obtains Personal Data from as a prospective client.

Personal Data

In this Privacy & Cookies Statement, the term Personal Data shall mean any information that either solely or in combination with other information enables an individual to be recognized either directly or indirectly.

The Firm may receive Personal Data from its clients, their shareholders, subsidiary and/or affiliate companies as necessary for the execution of required legal services and in order to establish a contractual lawyer-client relationship. Said Personal Data may be only used for the following purposes:

  1. Verifying the identity of the client and legal representatives.
  2. Creating, updating and preserving the client’s file.
  3. Collection and billing of the rendered services.

Additionally, the Firm may use said Personal Data for the following secondary purposes that are not essential for the requested service, but allow and facilitate better customer service:

  1. Marketing or advertising
  2. Commercial prospecting.
    To carry out the purposes described in this privacy notice, the Firm may collect the following personal data:
  3. Identification data, such as: name, address, date and place of birth, official identification.
  4. Contact information, such as: telephone number and email.
  5. Patrimonial and/or financial data: information on bank accounts and forms of payment, tax domicile, federal taxpayer’s registry number.
  6. Authorship data, such as: author’s name, pseudonym, percentage and type of participation.

The Client’s refusal for the use of his personal data for the above stated purposes shall not be a reason for the denial of the services and/or products that he requests or contracts.

Confidential Information

The Firm acknowledges and accepts that all information and/or documentation, disclosed by the Client by any means, in either verbal, written, graphic, audible, visual or any other analogous methods shall be deemed confidential in nature and thereby represent a valuable asset as a commercial and industrial secret. The term Confidential Information shall include, without limitation, studies of any nature, intellectual property, financial information, administrative information, computer systems and programs, databases, reports, working documents, customer control, business strategies; technical information, security codes, permits, logos, business information, patient, customer and business partner data, information from staff, consultants, and suppliers, market projections; information on products, materials, purchase and sale prices, costs, tenders, trade and industrial secrets, marketing, scientific and technical plans and strategies, projects, inventions, author’s work, manufacturing processes, formula information, application of patents, trademarks and licenses, businesses; business proposals, expansion policies, logistics, strategic data.

Consequently, the Firm agrees and undertakes to limit access to such Confidential Information, providing it only to its lawyers, as long as they need to know the Confidential Information related to the business relationships contemplated in the Service.

Likewise, the Firm recognizes that the information and documentation that they receive, obtain, prepare, produce or prepare during the course, duration or validity of this document, constitutes and will constitute confidential information for the purposes of the Service and, consequently, is and will be of the exclusive property of the party that has elaborated, produced or prepared it, in this case the Client.

ARCO Rights

The Client shall have the right to know which personal data is held by the Firm, what such information is used for and the conditions of use thereof (Access). Likewise, the Client shall have the right to request the correction of their personal information in the event that it is outdated, inaccurate or incomplete (Rectification); to be removed from our records or databases when the Client considers that it is not being used properly (Cancellation); as well as to oppose the use of personal data for specific purposes (Opposition). These rights are known as ARCO rights.

To exercise any of the ARCO rights, the Client shall submit the respective request through an email sent to trialattorneymexico@gmail.com.

The Client shall have the right to revoke his authorization to the Firm for the treatment of Personal Data. However, the Client accepts and acknowledges from this moment, that it may not be possible to attend to their request or terminate the use immediately, since it is possible that due to legal obligation the Firm requires further processing of the Client’s personal data. Likewise, the Client shall consider that for certain purposes, the revocation of his authorization will imply the impossibility of continuing to provide the requested service, or the conclusion of his contractual and commercial relationship.

Information Technologies on Website

The Firm hereby informs that this website may use cookies, web beacons or other technologies, through which it is possible to monitor the behavior of internet users to provide a better service and experience when browsing the webpage. The personal data collected through these technologies shall only be used for the following purposes in order to verify and confirm your identity, as well as to generate statistical data on the website’s performance.

Comments

The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
